Terms of Service

These terms apply when you use ensenya.app, join the Ensenya waitlist, take part in referrals or testing, join our community, or use the Ensenya app. Ensenya is made by Ethan Skelton, trading as ES Technology, in the United Kingdom (“we”, “us”). By using any of these, you agree to these terms. Please also read our Privacy Policy.

Who can use Ensenya

You must be 13 or older. If you’re under 18, you need permission from a parent or guardian. One waitlist place and one account per person.

The waitlist and founder rewards

  • Anyone who joins the waitlist with a confirmed email before launch becomes a founder.
  • Founder rewards and their conditions are set out on the Founder rewards page, including the founder’s scarf, the launch discount on Ensenya Más and the Thousand challenge. To claim them, sign up in the app with the same email you used for the waitlist.
  • Founder numbers are given in signup order and are for fun. They don’t guarantee a tester place or launch date.
  • Rewards have no cash value, can’t be transferred or sold, and may be withdrawn from accounts that break these terms.

Referrals

  • A referral counts when a new person joins with your link and confirms their own email.
  • Signups that are fake, use throwaway or duplicate email addresses, come from your own devices, or are otherwise used to game the programme don’t count. We may remove referrals, rewards or waitlist places linked to abuse.
  • Referral rewards are announced on the site and confirmed by a person before they’re given out. Any free Ensenya Más months start when the app launches.
  • We may change or end the referral programme, but rewards you’ve already earned will be honoured unless they were earned by breaking these terms.

Early access and testing

  • Tester places are limited and released in drops through our Discord community. Who gets a place depends on the drop rules we publish there. A place isn’t guaranteed.
  • Test versions are unfinished. They may have bugs, change without notice or lose progress, and test progress may not carry over to the public app.
  • Please don’t publicly share screenshots or recordings of test builds unless we say it’s fine. We may remove access from testers who misuse it.
  • Apple’s TestFlight terms and Google Play’s testing terms also apply to test builds.

Community

Our Discord server has its own rules, posted in the server. Be kind, especially to learners, and don’t post spam or harmful content. We may remove anyone from the community, the tester programme or the waitlist for serious or repeated breaches. Discord’s own terms also apply.

Your feedback and content

We love feedback. If you send us ideas, bug reports or suggestions, you agree we can use them to improve Ensenya without owing you anything, though we like to credit people when we can. You keep ownership of anything you post (like fan art), and you give us permission to share it on our channels with credit. Ask us to stop at any time.

Using the app

  • We give you a personal, non-transferable right to use Ensenya for your own learning.
  • Don’t copy, resell, reverse-engineer or misuse the app or its content, or try to get around limits or security.
  • Ensenya helps you learn Spanish, but we can’t promise a particular level of fluency or result.

Ensenya Más subscriptions

  • Ensenya is free to download. Ensenya Más is an optional paid subscription that adds more Focus and extra features.
  • Subscriptions are bought through the App Store or Google Play, renew automatically until cancelled, and can be cancelled in your store account settings. Prices are shown before you buy.
  • Refunds are handled by Apple or Google under their policies. Your legal rights as a consumer are not affected.

Our content

Ensenya’s name, logo, pet characters, artwork, lessons and software belong to us or our licensors. Please don’t use them without permission.

Availability and changes

We’re a small, growing team. We may change, pause or stop parts of the website, waitlist, community or app, and launch dates may move. We’ll give notice of significant changes where we reasonably can.

Liability

Nothing in these terms limits liability that can’t be limited by law, including for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer. Otherwise, we’re not responsible for losses that weren’t foreseeable, or for business losses. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or £50 if that’s higher.

Ending your use

You can stop using Ensenya, leave the waitlist or delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms.

Changes to these terms

We may update these terms as Ensenya grows. We’ll change the date at the top, and tell you about significant changes by email or in the app. If you keep using Ensenya after that, the new terms apply.

Law

These terms are governed by the law of England and Wales. If you live elsewhere in the UK or in the EU, you can also rely on the consumer protection laws of where you live and bring claims there.
